TopOff provides on-demand fuel delivery services to residential and commercial customers. We deliver quality fuel directly to your vehicle at a location of your choice. Our services are subject to availability in your area.

Eligibility

You must be at least 18 years old to use our service. By using TopOff, you represent and warrant that you meet this age requirement and have the legal capacity to enter into this agreement.

User Account

To use our service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us immediately of any unauthorized use

Orders and Delivery

Placing Orders

When you place an order through TopOff, you agree to pay the price displayed at the time of purchase, including any applicable taxes and fees. All orders are subject to acceptance and availability.

Delivery Requirements

You must ensure that:

• Your vehicle is accessible and unlocked at the delivery location
• The delivery location is safe and legal for fuel delivery
• You comply with all local laws and regulations
• The fuel cap is accessible and not damaged

Cancellation

You may cancel your order according to our cancellation policy. Cancellation fees may apply if you cancel after a driver has been dispatched.

Payment

We accept various forms of payment as displayed in the app. By providing payment information, you represent that you are authorized to use the payment method. You agree to pay all charges incurred through your account.

Safety and Compliance

You agree to comply with all applicable laws and regulations regarding fuel handling and storage. You acknowledge that fuel is a hazardous material and must be handled with care.

Prohibited Uses

You agree not to:

• Use the service for any illegal purpose
• Attempt to interfere with the service or servers
• Impersonate any person or entity
• Harass, threaten, or harm our employees or drivers
• Resell fuel received through our service
• Use the service in areas where it is not offered

Intellectual Property

All content, features, and functionality of the TopOff service are owned by TopOff and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reproduce any part of our service without permission.

Limitation of Liability

To the fullest extent permitted by law, TopOff shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount paid by you for the service in the past twelve months.

Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, secure, or error-free.

Indemnification

You agree to indemnify and hold harmless TopOff, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service or violation of these terms.

Dispute Resolution

Any disputes arising from these terms or your use of the service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial or to participate in a class action.

Termination

These terms shall be governed by and construed in accordance with the laws of the state in which TopOff is headquartered, without regard to its conflict of law provisions.

Severability
